Florida Lawmakers Push for Changes to Wine Bottle Size Limits

A new bill introduced in the Florida House of Representatives today aims to revise the state’s regulations on the size of wine containers that can be sold to consumers. The bill, which amends Section 564.05 of the Florida Statutes, seeks to adjust exceptions to the current maximum allowable capacity for individual wine containers.

Under the proposed legislation, the sale of wine in containers larger than 1 gallon would remain restricted, except in certain cases. The bill maintains existing exceptions for reusable or recyclable containers holding 5.16 gallons, as well as glass containers in sizes of 4.5, 6, 9, 12, or 15 liters. However, it adds clarification for qualified distributors and manufacturers, allowing them to sell wine in any container size when dealing with other qualified distributors or manufacturers.

The bill also reinforces that wine sold by licensed vendors for off-premises consumption must remain in its unopened original container.
A violation of these provisions would continue to be classified as a second-degree misdemeanor, carrying penalties as outlined in Florida’s criminal code.
